The Colleges are where the foundations are laid. Cultural evolution to renew the military ethos at the Colleges can cascade into and reinforce needed cultural change in the Canadian Armed Forces. We are optimistic that the review will help identify ways the Canadian Military Colleges can become better at recognizing and upholding the dignity of all persons while producing exemplary leaders for the Canadian Armed Forces and for Canada.<\/p>\n<p>The RMCAA continues to want to hear from our alumni and members on their experiences, opinions, and perspectives on the issues identified in the Arbour Report and on the changes needed at the Colleges. This Review was established to inform our efforts to build a more inclusive institution where all members feel protected, respected, and empowered to serve. In response to\u00a0<span class=\"nowrap\">Madame Arbour\u2019s<\/span>\u00a0<span class=\"nowrap\">48 recommendations<\/span>, we are taking meaningful action to build a healthy and respectful workplace, free of harassment, discrimination, and sexual misconduct.<\/p>\n<p>The IECR was informed by hundreds of your submissions and interviews, feedback from stakeholders, experts, other government entities, and more. Your experiences have helped inform our way forward, and we are grateful for your contributions.<\/p>\n<p>Over the past year, we have made steady progress and demonstrated that meaningful change is possible.<\/p>\n<p>The Chief, Professional Conduct and Culture organization is now the functional authority for sexual misconduct prevention training, and the Sexual Misconduct Support and Resource\u00a0<span class=\"nowrap\">Centre (SMSRC)<\/span>\u00a0was renamed to better reflect its mandate. The SMSRC has expanded its reach and services to better serve the wider Defence community, and we recently launched the first phase of the SMSRC\u2019s\u00a0<a href=\"https:\/\/www.canada.ca\/en\/department-national-defence\/news\/2023\/05\/supporting-survivors-and-delivering-meaningful-culture-change.html\" target=\"_blank\" rel=\"noopener\">Independent Legal Assistance program<\/a>\u00a0to provide access to legal assistance for people who have experienced sexual misconduct.<\/p>\n<p>External expert members of the Canadian Military College Review Board will be announced shortly and begin their work in the coming months. Concurrently, we have expanded the focus of exit interviews at Canadian Military Colleges to include cadets\u2019 experiences with sexual misconduct or discrimination.<\/p>\n<p>We have implemented new screening measures during the pre- and post-recruitment phases, including refined interview questions, and the use of enrollment release processes.<\/p>\n<p>In response to an interim recommendation, the Director of Military Prosecutions is no longer accepting charges of\u00a0<em>Criminal Code<\/em>\u00a0sexual offences for prosecution in military courts. As of late 2021, all new\u00a0<em>Criminal Code<\/em>\u00a0sexual offence charges are being laid in the civilian justice system. Courts martial continue to hear cases involving\u00a0<em>Criminal Code<\/em>\u00a0sexual offence charges which were laid in the military justice system prior to November 2021. Military Police, under the direction of the Canadian Forces Provost Marshal, also continue to work with civilian police partners across the country to transfer cases for investigation, and to support those who have experienced sexual misconduct in the military.<\/p>\n<p>At the same time, we continue to work closely with provincial and territorial governments to consider and chart the way forward for the more complex IECR final\u00a0<span class=\"nowrap\">recommendation 5<\/span>\u00a0which calls for the permanent removal of CAF jurisdiction for the investigation and prosecution of criminal sexual offences.<\/p>\n<p>As we deliver meaningful change together, we are committed to the highest standards of openness, transparency, and accountability to Canadians. That is why we appointed the\u00a0<a href=\"https:\/\/www.canada.ca\/en\/department-national-defence\/news\/2022\/10\/minister-anita-anand-appoints-external-monitor-to-oversee-national-defence-efforts-to-address-sexual-misconduct-and-harassment.html\" target=\"_blank\" rel=\"noopener\">External Monitor<\/a>, Jocelyne Therrien, whose\u00a0<a href=\"https:\/\/www.canada.ca\/en\/department-national-defence\/corporate\/reports-publications\/external-monitor-report-first-status-report-may2-2023.html\" target=\"_blank\" rel=\"noopener\">first biannual report<\/a>\u00a0was recently released. The report remarked positively on our progress, and provided us with areas for improvement, which we welcome.<\/p>\n<p>Together, we are making progress. We must and will continue our work to prevent and eradicate sexual misconduct, discrimination, and unacceptable behaviours across the Department of National Defence and Canadian Armed Forces. Long-lasting institutional change takes time, but we know that you are committed to this endeavour. During our town halls with you across Canada and around the globe, we have seen your belief in this mission.<\/p>\n<p>Failure is not an option, and we must continue to make progress every day.<\/p>\n<p>We thank you, Defence employees and Canadian Armed Forces members, for your hard work and dedication. Cet examen a \u00e9t\u00e9 men\u00e9 afin que nous puissions b\u00e2tir une institution plus inclusive o\u00f9 tous les membres du personnel se sentent prot\u00e9g\u00e9s, respect\u00e9s et aptes \u00e0 servir. Pour donner suite aux\u00a0<span class=\"nowrap\">48\u00a0recommandations<\/span>\u00a0formul\u00e9es par\u00a0<span class=\"nowrap\">M<sup>me<\/sup>\u00a0Arbour<\/span>, nous prenons des mesures concr\u00e8tes pour cr\u00e9er un milieu de travail sain et respectueux, lequel est exempt de harc\u00e8lement, de discrimination et d\u2019inconduite sexuelle.<\/p>\n<p>L\u2019EEIC s\u2019appuie sur des centaines d\u2019entrevues et les nombreux renseignements que vous avez soumis, de m\u00eame que, notamment, sur la r\u00e9troaction d\u2019intervenants, d\u2019experts et d\u2019autres entit\u00e9s du gouvernement. Vos exp\u00e9riences ont influ\u00e9 sur nos prochaines \u00e9tapes, et nous vous remercions de vos contributions.<\/p>\n<p>Au cours de la derni\u00e8re ann\u00e9e, nous avons accompli des progr\u00e8s constants et montr\u00e9 qu\u2019un v\u00e9ritable changement est possible.<\/p>\n<p>L\u2019organisation du Chef \u2013 Conduite professionnelle et culture est d\u00e9sormais l\u2019autorit\u00e9 fonctionnelle pour la formation sur la pr\u00e9vention de l\u2019inconduite sexuelle, et le Centre de soutien et de ressources sur l\u2019inconduite\u00a0<span class=\"nowrap\">sexuelle (CSRIS)<\/span>\u00a0a \u00e9t\u00e9 renomm\u00e9 de sorte \u00e0 mieux refl\u00e9ter son mandat. En outre, nous avons \u00e9largi la port\u00e9e et les services du CSRIS pour mieux servir l\u2019ensemble de la communaut\u00e9 de la D\u00e9fense, et nous avons lanc\u00e9 r\u00e9cemment la premi\u00e8re phase du\u00a0<a href=\"https:\/\/www.canada.ca\/fr\/ministere-defense-nationale\/nouvelles\/2023\/05\/soutenir-les-personnes-survivantes-et-realiser-un-changement-de-culture-significatif.html\" target=\"_blank\" rel=\"noopener\">programme d\u2019assistance juridique ind\u00e9pendante<\/a>\u00a0du CSRIS, qui aidera les personnes ayant subi de l\u2019inconduite sexuelle \u00e0 acc\u00e9der plus facilement \u00e0 une aide juridique.<\/p>\n<p>Les experts externes qui seront membres du comit\u00e9 d\u2019examen des Coll\u00e8ges militaires du Canada seront annonc\u00e9 prochainement et se mettront \u00e0 l\u2019\u0153uvre au cours des prochains mois. Entretemps, nous avons \u00e9largi la port\u00e9e des sondages de fin d\u2019\u00e9tudes men\u00e9s dans les coll\u00e8ges militaires canadiens, de sorte \u00e0 inclure les exp\u00e9riences des \u00e9l\u00e8ves-officiers relativement \u00e0 l\u2019inconduite sexuelle ou \u00e0 la discrimination.<\/p>\n<p>Nous avons aussi adopt\u00e9 de nouvelles mesures d\u2019\u00e9valuation aux \u00e9tapes avant et apr\u00e8s le recrutement, notamment des questions d\u2019entrevue am\u00e9lior\u00e9es et le recours \u00e0 des processus de lib\u00e9ration anticip\u00e9e.<\/p>\n<p>Par ailleurs, en r\u00e9ponse \u00e0 la recommandation provisoire formul\u00e9e par\u00a0<span class=\"nowrap\">M<sup>me<\/sup>\u00a0Arbour<\/span>, le Directeur\u00a0\u2013\u00a0Poursuites militaires n\u2019accepte plus le traitement par des tribunaux militaires d\u2019accusations d\u2019infractions sexuelles en vertu du\u00a0<em>Code criminel<\/em>. Ainsi, depuis la fin de\u00a02021, toutes les nouvelles accusations d\u2019infractions sexuelles en vertu du\u00a0<em>Code criminel<\/em>\u00a0sont port\u00e9es dans le syst\u00e8me de justice civil. Les cours martiales continuent toutefois de traiter les cas visant des accusations d\u2019infractions sexuelles en vertu du\u00a0<em>Code criminel<\/em>\u00a0ayant \u00e9t\u00e9 port\u00e9es dans le syst\u00e8me de justice militaire avant\u00a0<span class=\"nowrap\">novembre\u00a02021<\/span>. De plus, la police militaire, sous la direction du Grand Pr\u00e9v\u00f4t des Forces canadiennes, continue de travailler avec ses partenaires des services de police civils partout au pays pour transf\u00e9rer les cas applicables aux fins d\u2019enqu\u00eate et offrir du soutien aux personnes ayant v\u00e9cu une exp\u00e9rience d\u2019inconduite sexuelle dans les forces arm\u00e9es.<\/p>\n<p>Parall\u00e8lement, nous continuons de collaborer \u00e9troitement avec les gouvernements provinciaux et territoriaux afin de tracer la voie \u00e0 suivre pour la\u00a0<span class=\"nowrap\">recommandation n<sup>o<\/sup>\u00a05<\/span>\u00a0finale plus complexe de l\u2019EEIC, qui demande le retrait permanent de la comp\u00e9tence des FAC pour les enqu\u00eates et les poursuites concernant des infractions criminelles de nature sexuelle.<\/p>\n<p>Alors que nous apportons ensemble des changements significatifs, nous sommes r\u00e9solus \u00e0 maintenir les normes les plus strictes en mati\u00e8re d\u2019ouverture, de transparence et de responsabilit\u00e9 envers la population canadienne. C\u2019est pourquoi nous avons nomm\u00e9 Jocelyne\u00a0Therrien \u00e0 titre de\u00a0<a href=\"https:\/\/www.canada.ca\/fr\/ministere-defense-nationale\/nouvelles\/2022\/10\/la-ministre-anand-nomme-une-controleuse-externe-chargee-de-superviser-les-efforts-deployes-par-la-defense-nationale-pour-traiter-les-cas-de-harcele.html\" target=\"_blank\" rel=\"noopener\">contr\u00f4leuse externe<\/a>, et celle-ci a publi\u00e9 r\u00e9cemment son\u00a0<a href=\"https:\/\/www.canada.ca\/fr\/ministere-defense-nationale\/organisation\/rapports-publications\/rapport-surveillance-externe-premier-rapport-etape-2-mai-2023.html\" target=\"_blank\" rel=\"noopener\">premier rapport semestriel<\/a>.
